ISLAMABAD: The court of Prevention of Electronic Crimes on Tuesday confirmed the bail granting order of former PTI member of Punjab Assembly Aliya Hamza Malik in a case registered against her for uploading controversial video on social media. Judge Mohammad Afzal Majoka confirmed the bail of Ms Malik. The case against her was registered under sections 9 and 10 of the Prevention of Electronic Crimes Act (Peca) with the Cyber Crimes Wing of the Federal Investigation Agency (FIA). Her counsel objected that the prosecution invoked wrong sections of law against Ms Malik and pointed out that Section 9 could only be invoked if she belonged to a banned outfit. The judge inquired from the prosecution whether the transcript of her video was available, the prosecutor replied in affirmative. The judge again asked if there was any evidence to substantiate the allegation that she interfered in the internal matter of an institution. The prosecution played the video of Ms Malik inside the courtroom. The judge pointed out that she would be charged with Section 24A of Peca which is silent with regard to the punishment. The prosecutor argued that the case against the suspect was related to sections 9 and 10 of Peca, and there was nothing against her with regard to Section 24A. The judge briefly reserved the order and then announced the confirmation of the bail.
