PESHAWAR: A special anti-corruption court has confirmed the pre-arrest bail of a former director general of health services, Khyber Pakhtunkhwa, in a case of causing loss to exchequer by inducting an individual in service through fake appointment and posting orders. Senior special judge anti-corruption (provincial) Salahuddin ruled that it was evident from record that the petitioner, Mohammad Ayub Roz had not been nominated for having any role in preparation of alleged fake appointment order, fake officer order, fake service book, etc. Similarly, the judge ruled that there were no allegations that the petitioner received any illegal gratification from the co-accused, Mohammad Khayam. The court observed that keeping in view the facts and circumstances of the case, existence of mala-fide intention on part of the ACE authorities for implicating the petitioner in the instant case could not be ruled out. The ant-corruption establishment, Mardan, had registered an FIR on May 2, 2024, under different provisions of the Pakistan Penal Code and the Prevention of Corruption Act against Ayub Roz, who was then serving as executive district officer (health), Mardan. The ACE alleged that co-accused, Mohammad Khayam was appointed as dental technician in South Waziristan through a bogus appointment letter dated Feb 2, 2009. It was added that his services were then placed at the disposal of the EDO health Mardan through a bogus office order of April 21, 2012, issued by the director general health services, Peshawar. It is further alleged that Ayub Roz then transferred the co-accused to Type-D Hospital, Katlang, Mardan, on May 21, 2012. The ACE further alleged that during an inquiry, an audit was conducted, which showed that financial loss to the tune of Rs2.18 million was caused to the exchequer. Ashfaq Daudzai Advocate appeared for the petitioner and argued that his client was falsely implicated in the instant case and he had no nexus with the said offence. He argued that the petitioner had no role in preparation of fake appointment order, fake posting order and fake service book. He contended that the accounts section had got its own role in activation of pay of the said employee (co-accused), but no one from the account section of the EDO health Mardan was arrayed as accused in the case.
